Obama tells DOJ don’t defend statute…

President Obama unilaterally declared the Defense of Marriage Act (DOMA) unconstitutional, instructing the Department of Justice not to defend the statute in court. DOMA defines marriage as between a man and a woman. It also gives states the right to decide whether to recognize a same-sex marriage from another state.

The Constitution specifically provides that the President “shall take care that the Laws be faithfully executed” … and this includes defending those laws in court. The President and his Department of Justice have an obligation to defend and enforce existing laws — even laws they don’t like.

One of the problems with this: The President doesn’t get to decide what laws are constitutional in our system of government.

The idea that the President of the United States can order the Department of Justice not to defend a law, duly passed by Congress and signed into law by a former President, then-President Clinton, should send shock-waves through anyone who is concerned with civil rights and civil liberties.

The President isn’t a king. He doesn’t get to make decrees. He is the chief executive with the responsibility to enforce existing laws – even laws he may not like.

The Obama Administration’s action’s leads one to wonder if they want us to live in a constitutional republic or a monarchy?
